Terms of Service

By creating an account or using FanStudio ("the Service", operated by FanStudio, hereafter "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

We may update these Terms from time to time. Material changes will be communicated by email and surfaced in-app. Continued use after the effective date of an update constitutes acceptance.

• You must be at least 18 years old to use the Service.
• You must provide accurate registration information and keep it current.
• You are responsible for safeguarding your account credentials and for all activity under your account.
• You may not use the Service if previously suspended or banned by us.

You agree not to:

• Use the Service to create or distribute content that depicts minors in any sexual context, ever.
• Generate non-consensual intimate imagery of real, identifiable individuals.
• Impersonate any person or entity, or misrepresent your affiliation.
• Use the Service to harass, threaten, defame, or harm others.
• Distribute AI-generated or AI-manipulated media without the disclosures or labels required by applicable law (including, where applicable, transparency obligations under the EU AI Act).
• Bypass safeguards, rate limits, payment systems, or other technical controls.
• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Use automated means to scrape or harvest data beyond the documented API surface.
• Use the Service for any illegal purpose under applicable law.

We reserve the right to suspend or terminate any account that violates these rules, with or without prior notice depending on severity, and to cooperate with law enforcement when legally required.

The Service operates on a credit system. Credits are purchased via the Service and consumed when generating content or using paid features.

• Payments are processed through Stripe (card) or NowPayments (cryptocurrency). Payment data is handled by the respective provider — we do not store full card or wallet details.
• Charges appear on your card statement as ONLYREELSAI.
• Credits are non-refundable except where required by applicable consumer law or as explicitly stated in promotional terms. Consumed credits are not refundable in any event.
• Credits do not expire as long as the account remains active. On account closure or purge, unused credits are forfeited.
• Pricing is shown at the time of purchase and may change for future purchases. Existing balances are unaffected by pricing changes.
• Cryptocurrency payments are final and irreversible once confirmed on-chain. Where a refund is legally required for a cryptocurrency purchase, it is issued as account credit or fiat equivalent at our reasonable discretion.
• We may require additional verification before accepting a transaction — including 3-D Secure authentication or proof of identity — and may decline, limit, or restrict transactions or payment methods at our discretion to prevent fraud.
• We reserve the right to suspend credit purchases or features in cases of suspected fraud, chargeback abuse, or violation of these Terms.

Subscriptions. Some features are offered as auto-renewing subscriptions. The price and billing period are shown at checkout. Subscriptions renew automatically at the end of each billing period, charging your saved payment method, until cancelled. You may cancel at any time from /dashboard/settings; cancellation takes effect at the end of the current billing period. No partial-period refunds are given except where required by law. We will notify you by email before any price change, which applies from your next renewal.

EU/UK consumers — right of withdrawal. By purchasing credits or subscriptions you expressly request immediate performance and delivery of digital content, and you acknowledge that you thereby lose the statutory 14-day right of withdrawal once credits are added to your account or the service period begins.

If you believe a charge was made in error, you must contact support@fanstudio.ai and give us a reasonable opportunity to resolve the issue before initiating any dispute or chargeback with your bank, card issuer, or payment provider. Most billing issues are resolved within two business days.

Purchases completed while signed in to your account are deemed made or authorized by you. Initiating a chargeback or payment dispute without first contacting support as described above will result in immediate suspension of your account pending resolution of the dispute. Initiating a chargeback on a purchase whose credits have been partly or fully consumed, or while continuing to use the Service, is a material breach of these Terms. Upon receipt of a chargeback we may suspend or terminate the account, and any remaining credit balance is forfeited to the extent permitted by law.

We contest illegitimate disputes and will provide our payment processors, card networks, and issuing banks with relevant account records — including sign-in history, IP addresses, device data, usage logs, and support communications — as evidence. We reserve the right to recover chargeback fees and reasonable costs for disputes brought in bad faith, and to refuse future service to any account associated with chargeback abuse.

You retain ownership of any content you upload to the Service ("User Content") and of the content you generate using the Service ("Generated Content").

You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content and Generated Content solely for the purpose of operating the Service for you. This license terminates when you delete the content or your account, except where retention is required to comply with law or to fulfil financial / accounting obligations.

You represent and warrant that you have all necessary rights to the content you upload, and that any real, identifiable person depicted in content you upload — or whose likeness or face you use in generation — is at least 18 years old and has given you verifiable consent to that use.

The Service integrates with third-party platforms and APIs, including but not limited to:

• Clerk (authentication and user identity)
• Stripe and NowPayments (payments)
• Amazon Web Services (storage and infrastructure)
• AI model and inference providers (content generation)
• Fanvue (optional creator-platform connection for publishing)
• Resend (transactional email delivery)
• Sentry (error monitoring)

Your use of those integrations is also governed by the respective providers' terms. Where you connect a third-party account (e.g. Fanvue), you authorise us to access only the data scopes you explicitly grant during the OAuth flow.

You may delete your account at any time from /dashboard/settings. Deletion is preceded by a 30-day cool-off period during which you can cancel. After the cool-off elapses, your data is permanently and irreversibly removed, with the following exceptions:

• Credit purchase records are retained in anonymised form for accounting and tax compliance.
• Anonymised system logs may be retained for up to 90 days for security and abuse-detection purposes.
• Records reasonably necessary to resolve payment disputes, investigate fraud or abuse, or establish, exercise, or defend legal claims — including transaction records, sign-in and session history, IP addresses, usage logs, and related communications — are retained (pseudonymised where practicable) until the matter is closed and applicable card-network dispute windows have expired, and in any case no longer than 18 months.

We may suspend or terminate your account for material breach of these Terms; in such cases we will provide written notice when legally permissible. On termination for material breach, any remaining credit balance is forfeited to the extent permitted by law.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy of AI outputs, or uninterrupted availability.

AI-generated content may be inaccurate, biased, or unexpected. You are responsible for reviewing generated content before any commercial or public use.

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 100.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

You agree to indemnify and hold us harmless from any claim, demand, or damage (including reasonable attorneys' fees) arising from your User Content, your Generated Content, your violation of these Terms, or your violation of any third-party right.

These Terms are governed by the laws of the jurisdiction in which we are incorporated, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration on an individual basis, except where prohibited by applicable consumer law. To the extent permitted by law, you and we each waive the right to participate in a class action or class-wide arbitration. Either party may bring an individual claim in small-claims court where eligible.
